Indigenous interests in lands and waters take many forms, from absolute freehold title to a variety of non-exclusive use and access rights.   There are various protocols, and legislation in some countries, which set out the procedures for dealing with indigenous rights.  In most cases, some sort of negotiation with the indigenous title holders is required.

Golder Associates has the capability to develop and conclude a negotiation strategy for your involvement with indigenous communities and rights holders. We endeavour to provide timely outcomes that will allow projects to proceed without undue delay.  This can be as part of an integrated package, with other environmental documentation, or as a stand-alone service.

Our specialists can advise you on community consultation and protocols in the area of the project, and help you choose an option that will most easily and completely satisfy your project needs.  We provide negotiation services, from support to stand-alone representation.  We can draft agreements that meet legislative requirements and provide contractual certainty to the project.  We approach any negotiation concerning indigenous rights as an objective and fair process for all parties, which allows for maximum flexibility in crafting solutions.

Some of the services we can provide include:

Research:  Golder Associates will research the local legislation, protocol, and practice, including Indigenous law and custom, which govern Indigenous dealings in the jurisdiction of your project.

Negotiation strategy:   We will help you choose the best option for your project, and provide strategic advice and representation in order to lay the groundwork for a successful and timely negotiation.

Negotiation representation:  Our specialist can either represent you or accompany you in the negotiations, with the goal of creating a fair, long-lasting, and balanced agreement with positive results for both sides.

Drafting:  No matter how complex the terms of the agreement, we can draft documents that are clear and comprehensive.

Community consultation:  Golder Associates will develop and implement a community consultation plan for your project that will be culturally appropriate and satisfy legislative requirements.

Monitoring:  We provide a comprehensive service of agreement making, which includes long-term involvement and monitoring to ensure the continued satisfaction of all parties.
